ŞARTLARIN KABULÜ

The Terms and Conditions (“T&C’s” , “Terms of Use”) of this document are a legal Agreement between you being, as an Agent (“Member”, “User” “You”) and Paris for Tourism Service Ltd (“PTS” , “GSA”, “Ly Babylon Holiday”, “we”, “our”, “us”), the GSA of ly.babylonholiday.com (“Ly.Babylon Holiday”, “website”, “portal”). PTS, through this website as a travel agency can provide various travel and tourism-related services (Services) to Agents in Libya.

You accept these terms and conditions in full by using our website or signing up for an account. If you disagree with all or any part of these terms and conditions, you must not use our website.

The services that PTS provide to User are subject to the following Terms and Conditions (T&C’s) and the whole content of this agreement.

• Kullanıcı, tüm Kullanıcı Hesaplarından (herhangi bir ekran adı veya Parola altında) ve Kullanıcı Hesabı'nın tüm kullanımlarının bu Sözleşmenin hükümlerine tam olarak uymasını sağlamaktan sorumludur.
• Kullanıcı, Kullanıcı şifresi / şifrelerinin gizliliğini korumaktan sorumludur. Bu nedenle, hesap adınızı ve şifrenizi gizli tutmaktan sorumlusunuz.
• User is also responsible for any account that they have access to and any activity occurring in such an account. User will immediately notify us of any unauthorized access or use of their accounts. We are not responsible for any losses due to stolen or hacked passwords caused by or as a result of negligence. If PTS incurred with any damage due to this negligence, the User will be liable to compensate PTS accordingly.
• PTS does not have access to your current password, and for security reasons, we may only provide you with instructions on how to reset your password.
• PTS have the right to update any of your contact information on your account for billing and other purposes so as to be able to deliver its services to you. In addition, you represent and warrant that all information you provide to us when you create an account, access and use our services will remain complete and accurate.
• PTS shall have the right at any time to change or discontinue any aspect or feature of its portal ( Ly.babylonholiday.com ), unless it will be required for any further content updates, system upgrade, and maintenance
• You are recommended to review our Terms & Conditions frequently and/or whenever you wish to use our website & services. The most current and updated version of the T&C’s can be reviewed by clicking on the “Terms and Conditions” hypertext link located at the bottom of our portal/website.
• Privacy Policy: Your information will be treated in accordance with Ly.Babylon Holiday Privacy Policy, which is incorporated by reference into this Agreement

Şartlar ve Koşullardaki Değişiklik

Ly.Babylon Holiday shall have the right to change, modify and update these terms and conditions at any time without any notice. Changes will be effective as soon as they are published on the Ly.Babylon Holiday’s website. It is up to the User to check for changes in the Terms and Conditions.

HİZMET TANIMI

ly.babylonholiday.com is an online Travel and Tourism related portal dedicated to providing quality services to its agents/partners/clients, such as hotel accommodation, tour/holiday packages, etc.

The services, including any updates, enhancements, and new features, are subject to the T&C’s.

HOTEL AND OTHER ACCOMMODATION TYPE BOOKINGS:

Online Rezervasyon / Rezervasyon

All bookings/reservations must be made online. When a Member/Agent of the Ly.Babylon Holiday has completed the booking online, it is their responsibility to check and make sure all the reservation details (such as hotel address, hotel info, city and country details) on the pre-paid accommodation voucher are correct. Once the reservations/requests are confirmed, all Ly.Babylon Holiday policies for example but not limited to cancellation, amendment, no-show policies, payment and refund/ discount policies will be applicable to all Users and the Members/Agents that are using the Ly.Babylon Holiday System.

You agree that the Passenger nationality declaration is mandatory and must be determined by selecting “Client Nationality” at the time of booking. This information must be in accordance with the Passenger passport. False declaration of Passenger nationality may cause consequences for which we cannot be held liable. If the Agent does not change the Client’s Nationality, then the Agent’s nationality will be taken as the Passenger nationality by default. If any financial damage occurs due to a false nationality declaration, the Agent will be liable for all costs incurred.

Seyahat Eden Kişilerin İsimleri

Seyahat eden kişilerin isimleri acenteler tarafından doğru bir şekilde girilmelidir. Adı Soyadı takip etmeli ve konuğun adı olarak girilen kısaltmalar veya işaretler otel tarafından rezervasyonun reddedilmesine neden olabilir.

Oda Tipleri

Ly.Babylon holiday Agents are responsible for making sure the room type corresponds with the number of people making the booking. If an error is made by a Ly.Babylon Holiday agent, then the hotel has the right to refuse the room booking and will not be liable for any refunds.

Özel İstekler

It is always guaranteed that the room provided by the hotel will accommodate the number of Customer(s) booked. Specific room types, smoking preferences and bedding types for double/twin rooms cannot be guaranteed and are subject to availability at the time of check-in. Please advise us of any special requests prior to making your booking. Where possible, we endeavor to meet or arrange any such request. Confirmation that a special request has been noted or passed on is not a confirmation that the request will be met. All special requests are subject to availability and must be in writing, no requests will be accepted over the phone.

Geç Giriş

Bir müşterinin otelin normal check-in saatinden sonra gelmesi bekleniyorsa, müşteri veya Temsilci önceden geç varış hakkında oteli bilgilendirmelidir. Otele geç varış konusunda bilgi verilmemesi, alan / odaların serbest bırakılmasına neden olabilir.

Erken Ödeme

Early checkout related refund demands should be accompanied with the hotel issued early checkout permission in writing. Refunds may be claimed if and when our partner hotel does not invoice PTS/Ly.Babylon Holiday. However, the early checkout permission itself does not guarantee any refund. PTS will not be liable for any refunds or extra fees, if early checkout is at the customers own will.

Otel Kategorileri / Yerel Sınıflandırma ve Yıldız (*) Derecelendirmeleri

Star rating is a general overview of hotel regarding the approximate level of facilities, services and amenities available. However, this rating might be different from one country to another. For example, a 5* Kuala-lumpur hotel is not the same as a 5* Paris hotel. Ly.Babylon Holiday does not take the responsibility of the hotel categories and star (*) ratings since these have been provided to us and we accept and offer them as they are.

Ödeme ve Fiyatlar

Currency exchange rates are based on any related market fluctuations. Ly.Babylon Holiday shall have the right to update room rates on the website considering the market fluctuations.

Rates might change to reflect exchange rate fluctuations until the booking is fully paid, for bookings made in currencies other than EUR, USD. Once the booking is fully paid, there will be no more changes. You will be required to pay the full amount at the time of booking. We do not make any charges for payments by debit card, however payments made by credit cards might be subject to a handling fee.

Yerel Pazar Oranları

Not all of the hotel rates displayed on the Ly.Babylon Holiday website are applicable to the local market. In addition, some other markets may be affected, in such cases, the hotel is within its rights to change the rates without prior notice.

Resort Ücretleri

Some Hotels in particular countries charge a “resort fee” typically between $10 to $20 per night and per room and are directly paid to the hotel. This is regulated and implemented by related law by the concerned government and PTS/Ly.Babylon Holiday has no control over these charges.

Ek ve Arızi Masraflar

The fees displayed on the Ly.Babylon Holiday website may not include any additional charges that hotels apply for some specific services for example, but not limited to air conditioning, safe box, mini bar, TV rental, luggage storage, sauna, spa, swimming pool, car parking, etc and have to be paid by the customer when the customer uses them.

Also, some hotels may hold special events during festive times for example, but not limited to Christmas, and New Year, and guests must pay a compulsory charge for participating in these events. Ly.Babylon Holiday may not always be informed about such events and cannot be responsible for the additional charges by the hotels.

İptal ve Değişiklikler

We prefer that all cancellations and amendments are made on the Ly.Babylon Holiday website. Alternatively, you can contact the Ly.Babylon Holiday Reservation Team via e-mail or through the Ly.Babylon Holiday system before the cancellation deadline for that specific booking/hotel. We do not accept cancellations or amendments over the telephone.

Ly.Babylon Holiday will not take any responsibility for any changes and cancellations made directly with the hotel.

All requests for cancellations that are not made in a proper time frame are subject to a cancellation fee determined by Ly.Babylon Holiday. PTS may need to make changes to or correct errors in advertised and confirmed details. PTS may also cancel confirmed bookings, which we reserve the right to do so. We will notify you of the cancellation as soon as possible and refund you accordingly or offer you a booking equivalent to the original booking.

No compensation will be payable and the above option will not be available if we cancel as a result of your failure to comply with any requirement of these booking conditions entitling us to cancel the booking.

Değişikliği Böl

Ly.Babylon Holiday system does not allow to make split changes for multiple room bookings in case of a split amendment. If the cancellation and amendment policy is foreseen to be changeable, please make a new reservation for split room/s and inform Ly.Babylon Holiday support Team in order to try to serve as per your request.

Yinelenen Rezervasyonlar

Ly.Babylon booking never guarantees a confirmation of duplicate booking. You need to amend one of the reservations according to voucher conditions. If the hotel rejects to confirm duplicate bookings the agency shall take responsibility.

Müşterilerinizin Taşınması

The hotelier or provider takes the responsibility of finding you a similar standard alternate accommodation in case the hotel is booked or overbooked, closed, has maintenance problems and/ or cannot provide the rooms booked. If we receive any notice beforehand, Ly.Babylon Holiday team will inform you by e-mail.

Ly.Babylon holiday will try to provide an alternative in the desired area, but the situation may change according to the city and season.

Ly.Babylon Holiday accepts no liability for any losses or costs that might occur as a result of re-location as this is completely beyond Our (Ly.Babylon Holiday) control.

Şikâyetler

Ly.Babylon Holiday must be notified in case there is any issue or complaint that cannot be resolved at the hotel. You can use one of these ways to complain:
1- Log into your Ly.Babylon Holiday system and select the booking you want to complain about, then send us a message through the system explaining the issue.
2-Bize bir e-posta gönderin ve rezervasyon kimliğini ekleyin.
Ly.Babylon Holiday must be notified within 15 days after the checkout date. A copy of the complaint must also be submitted too and signed by the hotel manager.
Ly.Babylon Holiday will forward the complaints to the relevant party. Our team tries its best to reply to the complaints in a short period that may vary between 5 (five) to 20 (twenty) business days.
PTS will not be responsible for passport and visa requirements of the country you are traveling to.

Holiday tour packages:

• PTS reserves the right to substitute itineraries due to conditions beyond its control. In such cases we will do everything possible to ensure the locations visited, the excursions taken and the hotels offered are similar to the ones originally planned.
• PTS is not responsible for flight schedule changes.
• PTS is not responsible for any authorities from the airport or customs of the country you are traveling to and them, refusing to let you board or any loss of luggage.

KULLANICI DAVRANIŞI

PTS as the GSA of Ly.Babylon Holiday in Libya, recognizes and agree that Ly.Babylon Holiday portal copyrighted material, trademarks and any other business proprietary information, including text, software, photos, videos, graphics and the entire content of ly.babylonholiday.com are copyrighted as collective work and property of Moonline Travel and Trade Ltd.

Kullanıcı herhangi bir içeriği kısmen veya tamamen değiştiremez, yayınlayamaz, iletemez, devir veya satışa katılamaz veya hiçbir şekilde içerikten yararlanamaz.

ÜYE HESABI, ŞİFRESİ VE GÜVENLİĞİ

Kullanıcı, geçerli kayıt formunun istediği şekilde güncel, eksiksiz ve doğru bilgiler vererek oturum açmak için kayıt işlemini tamamlamalıdır. Kullanıcı ayrıca bir parola ve bir kullanıcı adı seçer ve onları korur. Kullanıcı, Parola ve hesabın gizliliğini korumaktan tamamen sorumludur. Ayrıca, Kullanıcı hesabı altında gerçekleşen tüm faaliyetlerden tamamen Kullanıcı sorumludur.

User agrees to notify us immediately of any unauthorized use of User’s account or any other security breach. PTS will not be liable for any loss that User may incur as a result of someone else using User’s password or account, either with or without User’s knowledge. However, User could be held liable for losses incurred by PTS and/or Moonline or another party due to someone else using User’s account or password to harm our portal. User may not use anyone else’s account at any time without the permission of the account holder.

YÜKÜMLÜLÜK SINIRLAMALARI

Web sitelerimizi / portallarımızı ve uygulamalarını / özelliklerini kullanmamız sonucunda, aşağıdakilerden herhangi biri için size karşı yükümlü olmayacağız:

SİTE KULLANILABİLİRLİĞİ

BÖLÜNEBİLİRLİK

Bu Şartların bir bölümünün uygulanamaz olduğu ortaya çıkarsa, bu bölüm doğru yasal anlam sağlamak için gerektiği kadar kaldırılacak veya düzenlenecek / değiştirilecek ve Sözleşmenin geri kalanı hala geçerli olacaktır.

KUVVET BÜYÜTME - GARANTİ REDDİ; SORUMLULUĞUN SINIRLANDIRILMASI

Neither PTS nor the Agent will be responsible/liable for any failure or delay in performance and/or delivery of their services, or any loss, injury, or inability of a passenger to perform the Voyage due to circumstances beyond its reasonable control, including without limitation war, riot, embargoes, strikes/demonstrations, hijackings, acts of civil or military authorities, act of terrorism, fire, floods, accidents, volcanic eruptions or other natural conditions of the earth or weather which make it or impossible for passenger to travel to the final destination.

Tüm anlaşma

Bu hüküm ve koşulların herhangi bir hükmü geçersiz veya uygulanamaz veya bağlayıcı değilse, (Temsilci) işbu belgede yer alan diğer tüm hükümlere bağlı kalacaktır. Böyle bir durumda, geçersiz hükümler, yürürlükteki yasaların izin verdiği ölçüde uygulanacaktır ve Siz (Temsilci), içerik ve amaç göz önüne alındığında, en azından geçersiz, uygulanamaz veya bağlayıcı olmayan hüküm ile benzer bir etki kabul etmeyi kabul edersiniz.

Use of the Ly.Babylon Holiday.com website is subject to your acceptance of Our terms and conditions. If You do not accept these Terms and Conditions, you must refrain from using the website.
